Notice to Manufacturers, Producers, Formulators and Registrants of Pesticides

ATTENTION:  Persons Responsible for the Federal Registration of Pesticides

SUBJECT:    False and Misleading Statements Related to Efficacy;
            Amendment to PR Notice 91-7.
     
On December 30, 1991, EPA issued PR Notice 91-7 requesting that registrants
remove claims of heightened efficacy from the label because they are false
or misleading.  EPA set a deadline of December 30, 1992 for registrants to
make such changes.

To allow time to consider comments received on PR Notice 91-7, EPA is extending
the compliance dates as set forth below.  EPA intends to issue an amendment to
PR Notice 91-7 to provide further guidance on how to comply with that notice.
Accordingly, the second paragraph of Section III of PR Notice 91-7 is revised
to read as follows:

All products distributed or sold by registrants and supplemental registrants
(i.e. distributors) after April 21, 1994 should bear labeling which is
consistent with this notice and complies with FIFRA.  It is the responsibility
of registrants to submit applications or notifications in adequate time to meet 
his deadline.  All products distributed or sold by persons other than
registrants or supplemental registrants after April 21, 1996 should bear correct
labeling.  After these dates, the agency may either issue a Notice of Intent
to Cancel a product or bring enforcement action against products bearing false
or misleading claims covered by this notice.
