The intent of this network is to inform interested parties of recent or impending pesticide use cancellations, tolerance revocations, and other items of agricultural interest. To the best of our knowledge, the uses mentioned here, unless otherwise indicated, will not appear on any label registered by the USEPA after those uses are canceled. We recommend that you express any concerns or questions you have to the contact mentioned below or to your NAPIAP State Liaison Representative. The USEPA has reinstated the food additive regulations for benomyl on PROCESSED TOMATO PRODUCTS and RAISINS and for trifluralin on PEPPERMINT and SPEARMINT OIL as of 9/12/94. Tolerances for these uses were revoked on 6/30/94, and announced here on 7/14/94. This reinstatement is the direct result of an order to stay these revoked tolerances by the Circuit Court of Appeals for the D.C. Circuit on 8/24/94. The USEPA is not reinstating the other food additive regulations mentioned in the 6/30/94 revocation order, because they were not the subject of the Court's 8/24/94 decision -- those tolerances remain revoked.

Miles Inc. plans to delete the use on ALFALFA and CLOVER from its labels of Di-Syston (disulfoton) due to the cost of reregistration on 11/15/94. The only other registrant (a reformulator) of this insecticide-miticide with an alfalfa use is expected to follow their lead.

The USEPA has revoked the tolerances for residues of ethylan on or in APPLES, BROCCOLI, BRUSSELS SPROUTS, CABBAGE, CAULIFLOWER, CHERRIES, KOHLRABI, LETTUCE, MEAT, MILK, PEARS, and SPINACH as of 9/30/94. The last products containing this insecticide were canceled in 1990 and the distribution of these products apparently stopped in 1985. Consequently, the USEPA is not recommending action levels for this pesticide. The proposal for this revocation was published here on 6/30/94 and the USEPA did not receive any public comments in response to the proposed rule.

Miles Inc. plans to delete the use on MACADAMIA NUTS from its labels of Morestan due to the cost of reregistration on 11/15/94. Miles will consider maintaining this use of this miticide on their labels if another party is willing to develop the data required for reregistration.

The Gowan Company plans to delete from their labels the final labeled use of phosmet on CORN and CITRUS due to the cost of reregistration. This action will be final for this insecticide as of 11/15/94.
