The intent of this network is to inform interested parties of recent or impending pesticide use cancellations, tolerance revocations, and other items of agricultural interest. To the best of our knowledge, the uses mentioned here, unless otherwise indicated, will not appear on any label registered by the USEPA after those uses are canceled. The USEPA has published an updated list of processed commodities and sites that have pesticide residue tolerances potentially affected by the Delaney Clause of the Federal Food, Drug and Cosmetic Act (FFDCA). This action has been taken because the Ninth Circuit Court of Appeals has ruled that the Delaney Clause bars tolerances for carcinogenic pesticides in processed food without regard to the degree of risk. This is the updated list of those commodities or sites that have residue tolerances for the indicated pesticide and whose tolerances will likely be revoked by the USEPA because of this new interpretation of the Delaney Clause. This is a combined list of pesticides with certain commodities and sites with Section 408 and 409 tolerances which may be affected. The registered uses causing these residues may be canceled if the relevant tolerances are revoked. This list was first published in February of 1993. This updated list includes three new pesticides and over 20 new combinations of pesticides and commodities.

lindane

The USEPA has proposed to not initiate a Special Review on the insecticide, lindane. The USEPA notified registrants of the possibility of a new Special Review on lindane in 1985 based on a study which showed irreversible kidney effects in male rats. They have determined that the kidney effects observed are specific to male rats and are not relevant to humans. This is not an indication that lindane has been cleared for reregistration; its usage is likely to be sharply curtailed once its reregistration review is complete. Written comments on this notice with reference to OPP-30000/10H should be sent to the Public Response Branch of EPA by 5/17/94.

ronnel (Korlan, Trolene)

The USEPA has revoked all tolerances for residues of the insecticide, ronnel as of 3/23/94. The USEPA is taking this action because all registered uses of ronnel were canceled by 1991. The proposal for this action was noted here on 12/22/93; the USEPA did not receive any public comments to the proposal. Written comments on this final action with reference to OPP-300310A should be sent to the EPA Hearing Clerk by 4/23/94.
