The USEPA has proposed the revocation of the food additive regulations for acephate, triadimefon, iprodione, and imazalil. Those food additive tolerances affected are for FOOD HANDLING ESTABLISHMENTS for acephate, milled fractions of BARLEY and WHEAT (except flour) for triadimefon, dried GINSENG and RAISINS for iprodione, and CITRUS oil for imazalil. This action is being taken in response to the court-ordered enforcement of the Delaney clause. The U.S. Court of Appeals, Ninth Circuit has barred the establishment of food additive regulations for pesticides which induce cancer, no matter how infinitesimal the risk. The USEPA has determined that acephate, triadimefon, imazalil, and iprodione all qualify as animal carcinogins. On February 9, 1995, the U.S. District Court for the Eastern District of California approved a settlement agreement between the USEPA and the Natural Resources Defense Council (NRDC), the State of California, et al., which sets a time table for issuing policies and regulations concerning pesticides affected by the Delaney clause. These policies could lead to the cancellation of some uses of 37 pesticides and the further review of over 40 others, due to: 1) the policy of linking processed food tolerances with raw food tolerances and, 2) the application of the Delaney clause prohibition of processed food tolerances for any chemical found to induce cancer in man or animals. EPA will issue final decisions on revocations within 5 years (for certain processed food tolerances within 24 months) on all affected processed and raw food tolerances. The uses that may be affected are presented here in the first and second group. The third group lists all the pesticides with approved food uses that may be affected by the Delaney clause.

The USEPA has extended the time frame for the sale and use of existing stocks of mevinphos from 2/28/95 to 11/30/95. We reported here on 7/14/94 that all uses of mevinphos were voluntarily canceled. Products in the hands of dealers and distributors are to be relabeled to provide additional worker protections. The mandatory relabeling will also prohibit use in greenhouses and on grapes. All mevinphos products in the channels-of-trade, including those in the hands of growers will be subject to recall. In addition, Amvac's and its supplemental registered products will be eligible for reimbursement.

The USEPA has proposed the revocation of tolerances on the residues of oryzalin on COTTONSEED, BARLEY GRAIN, WHEAT GRAIN, SUCCULENT PEAS, POTATOES, and SOYBEANS. Registered products containing this herbicide for these sites were canceled in October of 1989. Because EPA believes sufficient time has elapsed for residues to dissipate and they are unaware of any of these uses on imported commodities, they will not recommend action levels to replace the tolerances of these proposed revocations. Tolerances remain for oryzalin at 0.05 ppm on ALMOND HULLS, AVOCADOS, CITRUS FRUITS, FIGS, KIWIFURITS, NUTS, OLIVES, PISTACHIOS, POME FRUITS, POMEGRANATES, SMALL FRUITS, and STONE FRUITS. Written comments, with reference to OPP-300375, should be sent to the Public Response Branch of EPA by 3/20/95.
